In support of its ongoing effort to facilitate understanding of and compliance with the recently enacted Families First Coronavirus Response Act (FFCRA), the U.S. Department of Labor (DOL) has recently issued an exhaustive set of Questions and Answers to provide compliance assistance to employers and employees with respect to their responsibilities and rights under the FFCRA. In light of the unprecedented nature of this legislation, and in recognition of the often inconsistent and inaccurate interpretations offered by third parties under pressure to provide swift guidance, DOL is endeavoring to constantly update and expand upon the information being provided to the public. This DOL guidance has been changing frequently and without notice. Employers are encouraged to monitor regularly updated guidance issued directly by DOL. Employers relying on published DOL guidance should make every effort to confirm they are acting based on the most current guidance, and retain copies of the existing guidance at the relevant time, in the event the need arises later to establish actions were taken in good faith.
